Justice Department domestic counterterrorism unit leaders warned federal Judge Gladys Kessler on Thursday the administration needed better guidance to ensure the internal tools it provided Congress and judges fit national legal requirements as well as ongoing domestic investigations. In the document, senior Justice officials laid out the problems federal prosecutors will face because federal attorneys no longer do direct and in-house surveillance operations and it could "result to a chilling of critical investigative techniques by our prosecutors who must have guidance and tools to do proper follow-up operations, particularly against non-domestic threats like the Islamic State and Al Qaeda," Judge Kessler's order, issued Tuesday in one of several separate injunctions against the White House office counsel overseeing its investigation of Hillary Clinton in late 2001 and last year related to Trump family allegations. The order further details the administration's difficulty determining the exact requirements required for prosecutions outside the United States of major terrorism suspects without using any domestic case materials, since there "are many more such foreign targets than US ones." Judge Kessler made clear some targets are subject only on specific elements of an indictment against U.S. Terror suspects under the law without domestic case evidence -- particularly the alleged threat or motive.
